Associate Counsel - VID 137553
Reporting to the First Deputy General Counsel, the incumbent of this position will serve within the Office of General Counsel at the Office of Cannabis Management (OCM) and will manage one or more portions of the legal portfolio concerning:
the implementation of applicable laws and regulations relating to the siting of cannabis businesses in New York State and New York's true parties of interest requirements. The incumbent may also be requested to work on administrative proceedings or appeals. Furthermore, the incumbent will provide technical legal assistance and advice to the General Counsel, the Executive Director, and other Executive staff at OCM. The incumbent may also advise the Cannabis Control Board on matters requiring consideration and action by the Board. Duties may include, but are not limited to:
o Reviewing requests for and preparing recommendations to the Board regarding exceptions from location restrictions for cannabis dispensaries by licensees. o Reviewing municipal zoning requirements to advise OCM business units and leadership whether such requirements are unreasonable or impracticable under the Cannabis Law. o Reviewing applicant and licensee disclosures regarding their interests in licenses to determine whether such interests are consistent with the Cannabis Law restrictions on interests in multiple licenses. o Conducting legal research and preparing legal memoranda with opinions and citations and legal precedents in support of positions advanced in any assigned program area. o Providing legal counsel, advice and strategies in presenting evidence and testimony in litigation matters and administrative proceedings. o Preparing recommendations to the Board regarding appeals from administrative hearing determinations. o Responding to requests for guidance from the public on topics within assigned program areas, or as assigned by the First Deputy Counsel or General Counsel. o Advising OCM business units and executive leadership on legal questions arising within assigned program areas, or as assigned by the First Deputy Counsel or General Counsel. o Evaluating, commenting, and making recommendations on legislative proposals in this area by other agencies and the private sector. o Supervising one or more attorneys working within assigned program areas. o Perform other duties as assigned by the General Counsel.

Salary Range:
From $105500 to $133319 Annually
Minimum Qualification
Candidates must have been admitted to the New York State Bar and must have had four years of experience in the practice of law subsequent to admission to the Bar.Estimated Salary: $20 to $28 per hour based on qualifications.
